Privacy policy
1. Who we are
Resilience Psychotherapy provides online psychotherapy and counselling services. This notice explains how we collect, use, protect, retain and disclose personal data and how you may exercise your rights under Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486) (PDPO).
2. Personal data we may collect
name, contact details and identity information;
enquiry, referral and appointment information;
emergency-contact details where appropriate;
information about your presenting concerns, history, assessment and treatment;
clinical notes, treatment plans, questionnaires and outcome measures;
risk, safeguarding and care-coordination information;
communications with you;
payment and transaction information where required;
technical information generated through approved online systems.
3. Purposes of collection and use
responding to enquiries and arranging appointments;
assessing suitability for services and matching you with an appropriate practitioner;
providing, documenting, reviewing and coordinating psychological care;
communicating with you about your care;
managing safety, safeguarding and clinical risk;
processing payments and maintaining necessary business records;
quality assurance, complaints handling and professional governance;
meeting legal, regulatory, insurance and professional obligations.
We will ordinarily use your personal data only for the purpose for which it was collected or for a directly related purpose. A materially different use will be handled in accordance with the PDPO.
4. Personal Information Collection Statement
When you provide personal data to Resilience Psychotherapy, provision may be necessary for us to respond to your enquiry, assess your needs, arrange appointments or provide treatment. If required information is not provided, we may be unable to provide the relevant service.
Personal data may, where necessary and appropriate, be disclosed to the practitioner responsible for your care, authorised Resilience Psychotherapy personnel, approved service providers processing information on our behalf, and other persons or organisations where you have authorised disclosure or where disclosure is otherwise permitted or required by law.
5. Clinical confidentiality
Information disclosed in therapy is treated as confidential. Confidentiality is not absolute. Information may be disclosed without your consent where this is legally required or where disclosure is appropriately justified in circumstances involving serious safety, safeguarding or other legal concerns. Your practitioner will explain relevant limits of confidentiality as part of informed consent.
6. Online therapy and service providers
Resilience Psychotherapy uses approved technology to provide and administer online services. Some providers or practitioners may process information from locations outside Hong Kong. We take reasonable steps to assess relevant privacy and security arrangements and to maintain appropriate protections when information is processed remotely or by third-party providers.
7. Security
We take reasonably practicable steps to protect personal data against unauthorised or accidental access, processing, erasure, loss or use. Access to clinical information is restricted according to role and legitimate need.
8. Retention
Personal data is retained only for as long as necessary, taking account of the purpose for which it is held and applicable clinical, professional, legal, contractual, safeguarding and insurance requirements. Records that are no longer required will be securely destroyed, erased or anonymised.
9. Access and correction
You may request access to personal data held about you and request correction of inaccurate personal data in accordance with the PDPO. We may need to verify your identity and may apply lawful limitations where applicable.
10. Direct marketing
We will not automatically use information supplied for therapy or clinical enquiries for direct marketing. Where personal data is proposed to be used for direct marketing, we will follow the applicable notice and consent requirements and respect your right to require us to stop.
11. Questions, requests and complaints
Privacy enquiries, data access or correction requests, and privacy complaints should be directed to Resilience Psychotherapy's designated privacy contact.
